Final settlement reached on Bennington Levee

WASHINGTON — A final settlement has been reached in the ongoing saga of the 2011 Bennington Levee breach.

The Daviess County Commissioners and Council unanimously voted Wednesday to accept the settlement with the Bennington Levee board. In the settlement, the board will pay back the county $411,000 over 12 years for costs associated with rebuilding the levee.

The county will then drop its lawsuit against the levee board and forgive $150,000 in money the levee board owes the county.

All future bills for the levee after Sept. 29 will be assessed to landowners along the levee.

According to a release, the county has spent $1.25 million to repair the levee and get it back to the management stewardship of the Army Corps of Engineers.

Through litigation and settlement with the levee board and three farmers, the county has received $689,000 in repayment. The rest fell to the county due to state law the says if a levee board cannot meet its obligations, the county takes over responsibility.

The board meets in three weeks to ratify its portion of the settlement.
