NOTICE OF ADOPTION OF ORDINANCES
That on the 24th day of March, 2008, the Daviess County Commissioners of Daviess County adopted three (3) Ordinances as follows:
A. Retail Food Estab-lishment and/or Bed and Breakfast Establishment Ordinance, Ordinance No. 2008-1; and
B. An Ordinance Estab-lishing an Installer Certifi-cation for On-Site Sewage Disposal Systems, Ordin-ance No. 2008-2; and
C. Tattoo and Body-Piercing Businesses Or-dinance, Ordinance No. 2008-3.
Ordinance No. 2008-1 provides penalties for violation of said Ordinance and incorporates by reference Indiana Code (IC) 16-42-1, IC 16-42-2, IC 16-42-5, Indiana State De-partment of Health Rule(s) 410 Indiana Administration Code (IAC) 7-15.5, 410 IAC 7-20, 410 IAC 7-21-47, 410 IAC 7-22 (effective May, 2003), 410 IAC 7-23 (effective November 13, 2004), and 410 IAC 7-24 (effective January, 2005).
Ordinance No. 2008-2 provides as follows: Any person constructing, instal-ling or replacing any on-site sewage disposal system that is not certified in Daviess County shall be deemed to be in violation of the Ordinance. A person who is in violation of this Ordinance shall be fined for the first offense not more than Five Hundred Dollars ($500.00); for the second and each subsequent offense not more than One Thousand Dol-lars ($1,000.00).
Ordinance No. 2008-3 provides as follows: If an Operator of a Tattoo/Body-Piercing Establishment shall fail to obtain a business permit prior to conducting their business, or at any time after one has been issued but has expired, the Establishment may be subject to a fine of not more than Five Hun-dred Dollars ($500.00). Each day the Establish-ment shall be in violation of this Ordinance shall constitute a separate offense.
