Published August 03, 2009 01:37 pm - By virtue of a certified copy of a decree to me directed from the Clerk of Circuit Court of Daviess County, Indiana, in Cause No. 14C01-0704-MF-124 wherein Saxon Mortgage Services, Inc. was Plaintiff, and James Arthur Knepp, Norma Jean Knepp, Deutsche Bank Trust Company Americas, and The State of Indiana, were Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 19th day of August, 2009 at the hour of 10:00 a.m., or as soon thereafter as is possible, at the Daviess County Sheriff’s Depart-ment, 101 N.E. 4th Street, Washington, IN 47501, the fee simple of the whole body of Real Estate in Daviess County, Indiana.

By virtue of a certified copy of a decree to me directed from the Clerk of Circuit Court of Daviess County, Indiana, in Cause No. 14C01-0704-MF-124 wherein Saxon Mortgage Services, Inc. was Plaintiff, and James Arthur Knepp, Norma Jean Knepp, Deutsche Bank Trust Company Americas, and The State of Indiana, were Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 19th day of August, 2009 at the hour of 10:00 a.m., or as soon thereafter as is possible, at the Daviess County Sheriff’s Depart-ment, 101 N.E. 4th Street, Washington, IN 47501, the fee simple of the whole body of Real Estate in Daviess County, Indiana.

A part of the Southeast Quarter of the Southwest Quarter of Section 21, Township 3 North, Range 6 West, Barr Township, Daviess County, Indiana, beginning at a point on the half section and 681.57 feet North of the Southeast corner of said Southwest Quarter of said Section 21; thence continuing along said half section line, North, for 435.41 feet; thence North 88 degrees 54 minutes 41 seconds West for 100.00 feet; thence South 00 degrees 00 minutes 09 seconds East, for 435.47 feet; thence South 88 degrees 56 minutes 44 seconds East, for 100.00 feet, to the point of beginning, containing 1.00 acre, more or less.

Also an easement for ingress and egress as follows: A part of the Southeast Quarter of the Southwest Quarter of Section 21, Township 3 North, Range 6 West, Barr Township, Daviess County, Indiana, beginning at the Southeast corner of the Southwest Quarter of said Section 21; thence continuing along the half section line, North, for a distance of 1169.98 feet; thence North 88 degrees 54 minutes 41 seconds West, for 20 feet; thence South, parallel with said half second line, for 1116.82 feet; thence South 88 degrees 28 minutes 03 seconds East, for 20.01 feet, to the point of beginning, containing in said easement 0.51 acre, more or less.

The above descriptions were taken from a survey made by Marston R. Fowler, Jr., Registered Land Surveyor for the State of Indiana, #11238.

Beginning at a point on the half-section line and 651.57 feet North of the Southeast corner of said Quarter-Quarter Section, and continuing North, along the half-section line, for 30.00 feet, to an iron pin at the Southeast corner of an 1.00 acre tract; thence along the boundaries of said 1.00 acre tract for the next two (2) course calls: North 88 degrees 56 minutes 44 seconds West for 100 feet, to the Southwest corner of said 1.00 acre tract; thence North 00 degrees 00 minutes 09 seconds West for 435.47 feet to the Northwest corner of said 1.00 acre tract; thence North 88 degrees 54 minutes 41 seconds West for 63.74 feet, to a point; thence South for 465.51 feet, to a point; thence South 88 degrees 56 minutes 44seconds East for 163.74 feet, to the point of beginning, containing 0.75 acre, more or less.

Grantors also Quit Claim and release to grantees any interest of grantors in easement for ingress and egress 20 feet wide off the East side of a one acre tract heretofore conveyed by grantors to grantee by a deed recorded September 23, 1985, in Deed Record 131, Page 608, it not being the intention of the grantors to reserve for themselves or their successors in title any easement across said one acre tract or across this .75 acre tract.
