The Department of Nat-ural Resources, Division of Water, will hold a public meeting on January 5, 2009 at 6:00 p.m. in the Daviess County Court-house Commissioner’s Meeting Room (use rear entrance), 200 E. Walnut St., Washington, IN 47501. The purpose of this public meeting is to gather testimony on the following water supply contract application: Contract Num-ber: MWS-09-2, Applicant: Patoka Lake Regional Water & Sewer District; Request: Water Supply Contract for Public Water Supply Purposes; Reser-voir: Patoka Lake; Location: 2647 N State Road 545, Dubois, IN 47527, Dubois County.

Pursuant to IC 14-25-2 and 312 IAC 6.3, the public meeting is to review a contract request, for minimum quantities of stream flow or to sell water on a unit pricing basis for water supply purposes, from the water supply storage in a reservoir that was financed by the State of Indiana. The Natural Resources Com-mission shall consider the following factors to determine, subject to approval by the Attorney General and the Governor, whether to enter the contract: 1) Terms, conditions, and purposes of the authorizing legislation. 2) The likelihood of adverse effects to: a. Public Safety; b. The Environment; c. Naviga-tion; d. Recreation. 3) The availability of another source of water to the person making the request. 4) The proximity to the reservoir of any person that would receive water from the person making the request. 5) The water allocation priorities for the use of withdrawn water.

The meeting will include a presentation by the Department describing the nature of the request and the process by which the Commission will determine, subject to approval by the Attorney General and the Governor, whether to enter into a contract Patoka Lake Regional Water & Sewer. An opportunity for public comment on the pending request will be provided.
