A Washington man is facing a higher felony charge in connection with the death of a child last month in Loogootee. Indiana State Police originally arrested Bobby L. Leighty on a charge of neglect of a dependent causing serious bodily injury.
Since then Kyson Jones died of head trauma at Riley Children's Hospital in Indianapolis, and the Marion County Coroner has completed an autopsy of the child. Now the 26-year-old Leighty has had his charge amended to neglect of a dependent causing death.
The amended information filed in Martin Circuit Court alleged Leighty endangered the baby's life when he failed to provide or seek immediate medical attention after the child received abusive head trauma.
Authorities claim on July 23 Leighty was watching the baby in Loogootee when some time in the afternoon he noticed the child was unresponsive. He contacted family members before the child was taken to Daviess Community Hospital. He was then flown to Indianapolis where he died a couple of days later.
The new charge is a level one felony and carries a potential sentence of 20 to 40 years in prison and a possible $10,000 fine.
A preliminary hearing was held in Martin Circuit Court on the higher charge, and Leighty had a preliminary plea of not guilty entered on his behalf.
Leighty remains in the Martin County Jail on $100,000 cash bond.
